Abstract

ABSTRAK
Yusri (2020020103024) “Penegakan Hukum Terhadap Tindakan Premanisme
Lahan Parkir di Pasar Wameo Kota Baubau Prespektif Teori Lawrence M.
Friedman” yang dibimbingan oleh bapak Muh. Asrianto Zainal S.H.,M.Hum
sebagai pembimbing pertama dan bapak Iswandi S.H.,M.H sebagai pembimbing
kedua.
Aksi premanisme sampai saat ini masih marak terjadi terhadap beberapa
orang yang menjadi juru parkir liar di pasar Wameo. Padahal tempat khusus
parkir yang berada di pasar Wameo merupakan lahan parkir yang dikelolah oleh
pemerintah. Penelitian ini bertujuan untuk mengetahui kebijakan Polres Baubau
terkait premanisme lahan parkir dan untuk mengetahui penegakan hukum
terhadap premanisme lahan parkir di pasar wameo prespektif Lawrence M.
Friedman. Penelitian ini menggunakan jenis penelitian empiris dengan
menggunakan pendekatan undang-undang dan studi kasus. Adapun teknik
pengumpulan data menggunakan observasi, wawancara, dan dokumentasi. Hasil
penelitian ini menunjukkan bahwa kebijakan Polres Baubau dalam menangani
premanisme lahan parkir di Pasar Wameo yaitu sosialisasi kepada masyarakat,
membentuk tim pemburu preman dan operasi penertiban. Adapun penegakan
hukum terhadap tindakan premanisme lahan parkir di pasar Wameo berdasarkan
prespektif teori Lawrence M. Friedman yaitu terbagi menjadi tiga: Pertama,
substansi hukum yang digunakan untuk penanganan premanisme lahan parkir di
Pasar Wameo sudah baik dan komprehensif. Kedua, struktur hukum dalam hal ini
adalah tindakan dari Polsek Wolio dan Dinas Perhubungan sudah cukup baik
karena memberikan hasil yang baik dalam mengurangi jumlah kasus premanisme
lahan parkir di Pasar Wameo kota Baubau. Polsek Wolio melaksanakan upaya
pre-emptif, preventif, dan represif termasuk melakukan sosialisasi, patroli, dan
razia. Sementara itu, Dinas Perhubungan melakukan upaya penataan dan
pengawasan lahan parkir, menetapkan tarif dan retribusi parkir serta melegalkan
juru parkir ilegal. Terakhir, budaya hukum masyarakat di Pasar Wameo masih
tergolong lemah karena rendahnya pengetahuan dan pemahaman hukum
masyarakat, sehingga mengakibatkan maraknya aksi premanisme lahan parkir
yang kerap terjadi.

Yusri (2020020103024) "Law Enforcement Against Actions of Parking Lot
Thuggishness at Wameo Market, Baubau City, Lawrence M. Friedman's Theory
Perspective" under the guidance of Mr. Muh. Asrianto Zainal S.H., M.Hum as the
first supervisor and Mr. Iswandi S.H., M.H as the second supervisor.
Thuggery is still rampant until now against some people who become illegal
parking attendants at Wameo market. In fact, the special parking area in Wameo
market is a parking lot managed by the government. This study aims to determine
the Baubau Police policy regarding parking lot thuggery and to determine law
enforcement against parking lot thuggery in Wameo market from Lawrence M.
Friedman's perspective. This study uses an empirical research type using a
statutory approach and case studies. The data collection techniques use
observation, interviews, and documentation. The results of this study indicate that
the Baubau Police policy in dealing with parking lot thuggery in Wameo Market
is through socialization to the community, forming a thug hunting team and
control operations. Law enforcement against parking lot thuggery in Wameo
market based on Lawrence M. Friedman's theoretical perspective is divided into
three: First, the legal substance used to handle parking lot thuggery in Wameo
Market is good and comprehensive. Second, the legal structure in this case is the
actions of the Wolio Police and the Transportation Agency are quite good
because they provide good results in reducing the number of parking lot thuggery
cases at Wameo Market in Baubau City. The Wolio Police carry out pre-emptive,
preventive, and repressive efforts including conducting socialization, patrols, and
raids. Meanwhile, the Transportation Agency makes efforts to organize and
supervise parking lots, set parking rates and levies, and legalize illegal parking
attendants. Finally, the legal culture of the community at Wameo Market is still
relatively weak due to the low level of public knowledge and understanding of
law, resulting in the rampant parking lot thuggery that often occurs.
