Nama : Asmirawati, NIM : 18020101010, Judul Penelitian : Penentuan
Mahar Berdasarkan Stratifikasi Sosial Oleh Masyarakat Muslim
WakatobiPerspektif Maslahah Mursalah (Studi Kasus Di Kelurahan Sowa
Kecamatan Togo Binongko Kabupaten Wakatobi), Di Bimbing Oleh : Dr.
Ashadi L. Diab M.A., M.Hum. dan H. Muhammad Iqbal Lc, MHI.
Penelitian ini bertujuan untuk mengetahui penentuan mahar berdasarkan
stratifikasi sosial dan untuk mengetahui kedudukan penentuan mahar berdasarkan
stratifikasi sosial oleh masyarakat muslim kelurahan sowa kecamatan togo
binongko kabupaten wakatobi perspektif maslahah mursalah. Penulis
menggunakan metode penelitian kualitatif dengan jenis penelitian deskriptif
kualitatif. Metode pengumpulan data dalam penelitian ini yaitu observasi,
wawancara dan dokumentasi. Adapun metode analisis data yaitu display data,
reduksi data dan verifikasi data. Adapun hasil dari penelitian ini menunjukkan
bahwa: Penentuan mahar dalam pernikahan masyarakat kelurahan sowa
kecamatan togo binongko, besar kecilnya nominal mahar berdasarkan atas status
golongan sosial perempuan dalam masyarakat. Adapun golongan sosial
masyarakat di Kelurahan Sowa golongan masyarakat yang bermarga Siolimbona,
Ode dan maradika. Adapun tujuan diterapkannya aturan mengenai penentuan
mahar tersebut dikatakan oleh ketua adat yaitu untuk menjaga atau melidungi
hubungan antar sesama manusia. Adapun kedudukan penentuan mahar
berdasarkan startifikasi sosial di Kelurahan Sowa Kecamatan Togo Binongko
Kabupaten Wakatobi jika ditinjau dari perspektif maslahah mursalah ialah sebagai
aturan adat yang sudah dibuat oleh para leluhur dan wajib diikuti oleh masyarakat
setempat. Dilihat dari sisi filosofisnya aturan adat tersebut mendatangkan
kemaslahatan bagi masyarakat setempat, yaitu terhindar dari konflik berupa
pertengkaran antara kedua belah pihak keluarga yang ditimbulkan akibat adanya
suatu marga yang merasa tidak dihormati dan tidak pula dihargai.

This study aims to determine the determination of dowry based on social
stratification and to determine the legal status of determining dowry based on
social stratification by the Muslim community of Sowa Village, Togo Binongko
District, Wakatobi Regency from the perspective of maslahah mursalah. The
author uses a qualitative research method with a qualitative descriptive research
type. The data collection methods in this study are observation, interviews and
documentation. The data analysis methods are data display, data reduction and
data verification. The results of this study indicate that: Determination of dowry in
marriage in the Sowa Village community, Togo Binongko District, the amount of
dowry is based on the status of the social class of women in society. The social
class of society in Sowa Village is a group of people with the surnames
Siolimbona, Ode and Maradika. The purpose of implementing the rules regarding
the determination of dowry is said by the traditional leader to maintain or protect
relationships between fellow human beings. The position of determining the
dowry based on social stratification in Sowa Village, Togo Binongko District,
Wakatobi Regency, when viewed from the perspective of maslahah mursalah, is a
customary rule that has been made by the ancestors and must be followed by the
local community. Viewed from the philosophical side, this customary rule brings
benefits to the local community, namely avoiding conflict in the form of quarrels
between the two families caused by a clan that feels disrespected and
unappreciated.
