Abstract

Tata Negara (HTN) Fakultas Syariah (FASYA) Institut Agama Islam Negeri
(IAIN) Kendari. Analisis Pengaturan Batas Usia Capres Dan Cawapres
Berdasarkan Perspektif Siyasah Tanfidziyah. Pembimbing I : Mahruddin S.

Sistem presidensial merupakan suatu sistem dimana negara dipimpin oleh
seorang presiden yang bertugas sebagai kepala negara sekaligus sebagai kepala
pemerintahan. Presiden dan Wakil Presiden dipilih secara demokrasi langsung atau
pemilihan langsung oleh rakyat melalui pemilu. Munculnya perdebatan seputar
keputusan Mahkamah Konstitusi mengenai batas usia sebagai salah satu parameter
yang mengatur kualifikasi pemimpin dalam arena politik. Jenis penelitian ini adalah
yuridis normatif, dengan menggunakan pendekatan perundang-undangan dan
pendekatan konseptual. Bahan hukum primer, sekunder serta tersier yang diperoleh
dianalisis dengan menggunakan metode yuridis kualitatif. Hasil dari penelitian ini
untuk menyimpulkan 1) bahwa idealitas pengaturan batas usia capres dan cawapres
di Indonesia telah di atur di UU No 7 tahun 2017 pasal 169 huruf q. Bahwa di
dalam UU tersebut, telah mengidealkan batas usia di umur 40 tahun, sehingga
penelitian ini tetap merekomendasikan UU No 7 tahun 2017 pasal 169 huruf q batas
usia capres dan cawapres di umur 40 tahun. 2) Dalam aturan undang-undang telah
jelas usia pemimpin(capres dan cawapres) adalah di umur 40 tahun, sehingga
peneliti mengkolerasikan antara batas usia 40 tahun dengan hukum islam yaitu
siyasah tanfidziyah. Yang dimana dalam islam bahwa, Nabi Muhammad SAW
telah di angkat menjadi Rasulullah/memimpin umat manusia di umur 40 tahun dan
dibeberapa ayat Al-Quran juga, telah menyinggung mengenai umur 40 tahun
tersebut.

The presidential system is a system where the country is led by a president
who serves as head of state as well as head of government. The President and Vice
President are elected by direct democracy or direct election by the people through
elections. There is a debate surrounding the Constitutional Court's decision
regarding the age limit as one of the parameters that regulates the qualifications of
leaders in the political arena. This type of research is normative juridical, using a
statutory approach and a conceptual approach. The primary, secondary and
tertiary legal materials obtained were analyzed using qualitative juridical methods.
The results of this research conclude 1) that the ideality of setting age limits for
presidential and vice presidential candidates in Indonesia has been regulated in
Law No. 7 of 2017 article 169 letter q. That in this law, the age limit has been
idealized at 40 years, so this research still recommends Law No. 7 of 2017 article
169 letter q to limit the age for presidential and vice-presidential candidates at 40
years. 2) The legal regulations make it clear that the age of leaders (presidential
and vice-presidential candidates) is 40 years old, so researchers correlate the age
limit of 40 years with Islamic law, namely siyasah tanfidziyah. In Islam, the
Prophet Muhammad SAW was appointed as the Messenger of Allah/leader of
mankind at the age of 40 years and in several verses of the Koran, he also
mentioned the age of 40 years.
