Nama : Ismail, Nim : 18020103035, Judul Skripsi : “Tinjauan Normatif
Pembentukan Peraturan Perundang-undangan Dengan Metode Omnibus
Law Berdasarkan UU No 13 Tahun 2022 (Studi Pembentukan UU No 11
Tahun 2020 Tentang Cipta Kerja)”, Pembimbing Pertama : Ahmadi
S.HI,M.H, Pembimbing Kedua : L.M. Iman A.A Uke, SH,MH
Penelitian ini dilakukan dengan tujuan untuk menjawab tentang
pembentukan peraturan perundang-undangan dengan metode Omnibus Law
berdasarkan UU No 13 Tahun 2022 tentang pembentukan peraturan perundang
undangan dan pembentukan UU No 11 Tahun 2022 Tentang Cipta Kerja dengan
metode Omnibus Law berdasarkan teori pembentukan peraturan perundang
undangan. Adapun jenis penelitian ini yaitu penelitian hukum normatif
menggunakan metode studi pustaka dengan pendekatan statute approach. Dengan
memfokuskan telaah asas dan teori hukum secara legal prosedural dalam menilai
keberadaan Undang-undang No 11 Tahun 2020 Tentang Cipta Kerja yang
mengadopsi metode Omnibus Law. Berdasarkan hasil dari penelitian yang
dilakukan dapat menunjukan bahwa Bahwa Metode Omnibus Law yang
digunakan dalam pembentukan UU No 11 Tahun 2020 Tentang Cipta Kerja,
ditinjau berdasarkan UU No 13 Tahun 2022 Tentang Pembentukan Peraturan
Perundang-undangan, dari segi Tempus/waktu keberadaan pemberlakuan dinilai
mendahului pedoman atau petunjuk pembentukannya. Padahal UU No 12 Tahun
2011 Tentang Pembentukan Peraturan Perundang-undangan belum
mengakomodasi metode Omnibus Law sebagai suatu mekanisme prosedural
pembentukan, hal itu bisa dilihat dibagian konsideran/menimbang yang
mengisyaratkan perlunya ada suatu metode yang baku dan pasti, Sedangkan dalam
UU No 13 Tahun 2022 tentang pembentukan peraturan perundang-undangan
perubahan kedua sudah memasukkan dan mengakomodasi omnibus law sebagai
suatu metode pembentukan peraturan perundang-undangan. Dari perspektif teori
pembentukan perundang-undangan yang baik, menjelaskan bahwa Undang
Undang tidak boleh berlaku surut/retroaktif. Sebagaimana pembentukan UU No
11 Tahun 2020 ketika dinilai berdasarkan UU No 13 Tahun 2022 Tentang
Pembentukan Peraturan Perundang-undangan justru cacat formil atau tidak sesuai
prosedural pembentukan Dan juga putusan MK No 91/PUU-XVIII 2020 telah
memutuskan bahwa UU No 11 Tahun 2020 Tentang Cipta Kerja itu Inkostitusinal
bersyarat dikarenakan dalam pembentukannya kurangnya partispasi publik secara
bermakna. Akan tetapi pemerintah justru mengeluarkan Perpu No 2 Tahun 2022
Tentang Cipta Kerja justru penulis menilai malah mencederai putusan MK, karena
sifat dari pada Perpu itu kurang partisipasi publik.

The Formation Of Law No. 11 Of 2020 Concerning Job Creation)”, First

This research was conducted with the aim of answering about to from
statutory regulations using the omnibus law method based on law No 13 of 2022
concerning the formation statutory regulations and to from law No 11 of 2022
concerning job creation using the omnibus law method based on the theory of
forming statutory regulations. The type of this research is normative legal research
using the literature study method with a statute approach. By focusing on te
review of legal principle and theories legally procedural in assessing the existence
of Law No. 11 of 2020 concerning job Omnibus Law method. Based on the
results showing, it can be concluded that the omnibus law method used in
formation in law No 11 of 2020 concerning work copyright, reviewed based on
law No 13 of 2022 concerning the formation of statutory regulations, in terms of
the term/time of implementation is considered to precede the guidelines or
instructions. Its formation. Even though UU No 12 0f 2011 concerning the
formation of statutory regulations has not yet accommodated the omnibus law
method as a procedural mechanism for formation, this can be seen in the
consideration/ consideration section which indicated the need for a standard and
definite method, whereas in UU No 13 of 2022 regarding the formation of
statutory regulations, the seconds amendment includes and accommodates the
omnibus law as a method for forming statutory regulations. From the perspective
of the theory of the formation of good statutory regulations, it explains that laws
must not apply retroactively as the formation of law No 11 of 2020 when assessed
based on law No 13 of 2022 concerning the formation of statutory regulations is
actually formally flawed or does not comply wit the procedural mechanism of
formation an also MK decision No 91/PUU-XVIII 2020 has decited that law No
11 of 2020 concerning job creation is conditionally unconstutional due to the lack
of meaningful public participation in its formation. Howefer, the government
actually issued Perpu No 2 of 2022 concerning job creation. In fact, the author
believes that it actually harms the constitutional court’s decision, because the
nature of the Perpu lacks public participation.
