Nama: Sulfiani Nim: 2021020103012 Judul: Implementasi Peraturan Daerah
(Perda) Kabupaten Bombana Nomor 4 Tahun 2015 Tentang Pengakuan,
Perlindungan Dan Pemberdayaan Masyarakat Adat Moronene Hukaea Laea
Di Kabupaten Bombana (Studi Taman Nasional Rawa Aopa Watumohai).
Dibimbing Oleh: Dr. Ahmadi, S.HI., M.H selaku pembimbing I dan Dr.
Jalaluddin Rum SE, S.H., MSi selaku pembimbing II
Penelitian ini merupakan penelitian hukum normatif empiris. Penelitian ini
bertujuan untuk mengetahui implementasi Perda No 4 Tahun 2015 Tentang
Pengakuan, Perlindungan, dan Pemberdayaan Masyarakat Adat Moronene Hukaea
Laea (Studi Taman Nasional Rawa Aopa Watumohai). Penelitian ini
menggunakan pendekatan Perundang-Undangan dan Pendekatan Kasus, informan
terdiri dari 5 orang melalui wawancara, dokumentasi, dan observasi.
Pengumpulan data dengan reduksi data, sajian data, dan melakukan penarikan
kesimpulan serta uji keabsahan data dengan triangulasi waktu, sumber, dan
tekhnik. Hasil penelitian menunjukkan bahwa Perda No 4 Tahun 2015 Tentang
Pengakuan, Perlindungan, dan Pemberdayaan Masyarakat Adat Moronene Hukaea
Laea telah berjalan namun belum terimplementasi secara maksimal. Hal ini terjadi
karena dalam Peraturan Daerah No 4 Tahun 2015 tersebut tidak ada satupun pasal
yang menjelaskan luas wilayah masyarakat adat Moronene Hukaea Laea.
Kemudian letak wilayah adat Moronene Hukaea Laea yang berada di dalam
kawasan Taman Nasional Rawa Aopa Watumohai yang merupakan hutan negara.
Hal lain yang menghambat implementasi Perda No 4 Tahun 2015 adalah
kurangnya sosialisasi dan edukasi terkait Perda kepada pelaksana kebijakan dan
seluruh lapisan masyarakat adat yang menjadi subjek perlindungan.

Indigenous Peoples in Bombana Regency (Study of Aopa Watumohai Swamp

Jalaluddin Rum SE, S.H., MSi as supervisor II
This research is an empirical normative law research. This study aims to
determine the implementation of Regional Regulation No. 4 of 2015 concerning
the Recognition, Protection, and Empowerment of the Moronene Hukaea Laea
Indigenous Peoples (Study of Swamp Aopa Watumohai National Park). This study
uses the Legislation and Case Approach approaches, informants consist of 5
people through interviews, documentation, and observation. Data collection by
data reduction, data presentation, and drawing conclusions and testing the
validity of data by triangulating time, sources, and techniques. The results of the
study show that Regional Regulation No. 4 of 2015 concerning the Recognition,
Protection, and Empowerment of the Moronene Hukaea Laea Indigenous Peoples
has been running but has not been implemented optimally. This happened because
in Regional Regulation No. 4 of 2015 there is not a single article that describes
the area of the Moronene Hukaea Laia indigenous people. Then lies the
Moronene Hukaea Laea customary area which is within the Aopa Watumohai
Swamp National Park area which is a state forest. Another thing that hinders the
implementation of Regional Regulation No. 4 of 2015 is the lack of socialization
and education related to the Regional Regulation to policy implementers and all
levels of indigenous peoples who are the subject of protection
