Harga Tarif Grab Bike Perspektif Ijarah (Studi Kasus Di Kota Kendari).
Dibimbing Oleh Muh. Asrianto Zainal SH, M.Hum dan Adenisatrawan S.Hi,
M.H.
Penelitian ini bertujuan untuk menganalisis praktik pembulatan harga pada
layanan Grab Bike di Kota Kendari ditinjau dari perspektif akad ijarah dalam fiqh
muamalah. Metode yang digunakan adalah penelitian hukum normatif-empiris
dengan pendekatan studi kasus, melalui wawancara, observasi, dan dokumentasi
terhadap sembilan driver Grab Bike di Kota Kendari. Hasil penelitian menunjukkan
bahwa praktik pembulatan tarif umumnya dilakukan atas inisiatif driver dan bukan
kebijakan resmi perusahaan. Dari sembilan driver yang diwawancarai, tujuh orang
melakukan pembulatan secara sepihak tanpa pemberitahuan kepada pengguna,
sedangkan dua orang lainnya melakukannya setelah mendapat persetujuan.
Pembulatan ini muncul karena keterbatasan uang receh, kebiasaan masyarakat, dan
efisiensi waktu, namun belum sesuai dengan Pasal 6 Ayat (4) Permendag No. 35/MDag/Per/7/2013

yang mewajibkan pemberitahuan kepada konsumen. Dari
perspektif ijarah, praktik pembulatan harga dalam layanan Grab Bike belum
sepenuhnya sesuai prinsip syariah karena sering dilakukan tanpa kerelaan kedua
pihak (an-taradhin). Dalam akad ijarah, hal ini menimbulkan gharar dan membuat
akad fasid, meski selisih kecil. Namun, jika dilakukan dengan komunikasi dan
persetujuan penumpang, akad tetap sah karena memenuhi prinsip keadilan dan
kerelaan. Jadi, pembulatan hanya dibenarkan bila transparan dan disetujui bersama.

Prices for Grab Bike Fare from Ijarah Perspective (Case Study in Kendari

This research aims to analyze the practice of price rounding on Grab Bike services
in Kendari City from the perspective of the ijarah contract in muamalah fiqh. The
method used is normative-empirical legal research with a case study approach,
through interviews, observation and documentation of nine Grab Bike drivers in
Kendari City. The research results show that the practice of fare rounding is
generally carried out at the driver's initiative and is not an official company policy.
Of the nine drivers interviewed, seven carried out rounding unilaterally without
notifying users, while the other two did so after obtaining approval. This rounding
arises due to limited change, people's habits and time efficiency, but is not in
accordance with Article 6 Paragraph (4) of Minister of Trade Regulation No. 35/MDag/Per/7/2013

which requires notification to consumers. From an ijarah
perspective, the practice of rounding prices in the Grab Bike service is not fully in
accordance with sharia principles because it is often done without the consent of
both parties (an-taradhin). In an ijarah contract, this creates gharar and makes the
contract fasid, even though the difference is small. However, if it is carried out with
communication and the consent of the passenger, the contract remains valid because
it meets the principles of fairness and consent. So, rounding is only justified if it is
transparent and mutually agreed upon.
