Nama: Shinta, Nim: 17020102040, Judul Skrispsi: “Klausula Baku Pada
Tiket Parkir Perspektif Hukum Perlindungan Konsumen (Studi di Wisata
Pantai Pasir Putih Desa Watumelewe Kecamatan Tinanggea Kab Konawe
Selatan)”, Pembimbing Pertama: Dr. Ashadi L. Diab M.A., M.Hum.,

Hasil observasi terdapat data 2 (dua) orang yang pernah kehilangan barang
berupa helm pada saat menggunakan jasa parkir dikarenakan adanya pencantuman
klasula baku pada tiket parkir, dari isi perjanjian yang mengandung klausula baku
tersebut pengelola parkir sepenuhnya lepas tanggung jawab dan adanya
penyalahgunaan keadaan terhadap pengunjung Pantai. Tujuan penelitian ini
adalah untuk mengetahui keabsahan pencantuman klausula baku pada tiket parkir
kendaraan bermotor di Wisata Pantai Pasir Putih Desa Watumelewe Kecamatan
Tinanggea Kabupaten Konawe Selatan, untuk mengetahui perspektif perlindungan
hukum terhadap konsumen atas akibat hukum pencantuman klausula baku
menurut Undang-Undang Perlindungan Konsumen.
Penelitian ini adalah penelitian hukum empiris yang merupakan penelitian
hukum yang menggunakan fakta-fakta empiris serta perilaku verbal dengan
pendekatan kasus dan peraturan perundang-undangan. Penelitian ini
menggunakan metode pengambilan data melalui pengamatan langsung dengan
cara observasi, wawancara, dan dokumentasi.
Berdasarkan hasil penelitian yang penulis lakukan dapat disimpulkan
bahwa keabsahan pencantuman klausula baku pada tiket parkir di Wisata Pantai
Pasir Putih Desa Watumelewe Kecanatan Tinanggea yang mengandung klausula
eksonerasi ini tidak dibenarkan atau tidak di perbolehkan karena tidak memenuhi
syarat sahnya perjanjian yaitu syarat “Kesepakatan para pihak” dalam hal ini
penyelah gunaan keadaan yang dilakukan oleh pemilik usaha, dan klausula
tersebut bertentangan dengan Undang-Undang Nomor 8 Tahun 1999 tentang
Perlindungan Konsumen Pasal 18 ayat (1), kedua perspektif perlindungan hukum
terhadap konsumen atas akibat hukum pencantuman klausula baku menurut
Undang-undang Perlindungan Konsumen, perlindungan hukum ada 2 (dua) yaitu
perlindungan hukum yang diberikan oleh Pemerintah untuk mencega sebelum
terjadinya pelanggaran hal ini terdapat dalam peraturan Perundang-undangan,
selanjutnya perlindungan hukum akhir yang berupa sanksi pidana penjara 5 (lima)
tahun, pidana denda sebanyak Rp 2.000,000,000.00 (dua miliyar rupiah) dan
hukum tambahan lainnya yang diberikan ketika terjadi sengketa.

Based on observations, there are data on 2 (two) people who have lost
items in the form of helmets when using parking services due to the inclusion of
standard clauses on parking tickets, from the contents of the agreement
containing standard clauses, the parking manager is competely released from
responsibility and ther is abuse of conditions towards beach visitors. The purpose
of this study was to determine the validity of the inclusion of standard clauses on
motorized vehicle parking ticket at White Sand Beach Tourism, Watumelewe
Village, Tinanggea District, to find out the perspective of legal protection for
consumers for the legal consequences of including standard clauses according to
the consumers protection.
This research is empitical legal research which is legal research that uses
empirical factsand verbal behavior with a case approach and statutory
regulations. This study uses data collection methods through direct observation
by means of observation, interviews, and documentation.
Based on the results of the research conducted by the authors, it can be
concluded that the validity of the inclusion of standard clauses on parking tickets
at White Sand Beach Tourism, Watumelewe Village, Tinanggea District which
contains this exoneration clause is not justified or not allowed because it does not
meet the requirements for the validity of the agreement, namely the condition for
“agreement of the parties” in this case the misuse of circumstances by the
business owner, and this clause is contrary to the law Number 8 of 1999
concerning Consumer Protection Articele 18 paragraph (1), the two perspectives
of legal protection for consumers for the legal consequences of including
standard clauses according to the Consumer Protection Act, here are 2 (two)
legal protections, namely the legal protection provided by the Government to
prevent violations before the occurrence of this matter contained in the
legislation, then the final legal protection in the form of a criminal sanction of 5
(five) years imprisonment, a fine of Rp 2 000,000,000.00 (two billion rupiah) and
other additional laws given whwn a dispute occurs.
