Abstract

Filda Aryanti. NIM. 2020020102009. Praktik Utang Piutang Dengan
Pelunasan Hasil Panen (Rumput Laut) Perspektif Maslahah Mursalah (Studi
Kasus Desa Waemputtang Kecamatan Poleang Selatan Kabupaten
Bombana). Dibimbing oleh: Pembimbing Pertama: Dr. Ashadi L. Diab M.A.,
M.HUM. Pembimbing Kedua: Syamsul Darlis S.H., M.H
Penelitian ini bertujuan untuk menganalisis praktik utang piutang yang
dilakukan dengan pelunasan hasil panen rumput laut di Desa Waemputtang,
Kecamatan Poleang Selatan, Kabupaten Bombana, dari perspektif prinsip maslahah
mursalah. Metode yang digunakan adalah penelitian kualitatif dengan
pengumpulan data melalui wawancara, observasi, dan analisis dokumen. Hasil
penelitian menunjukkan bahwa praktik utang piutang tersebut tidak sepenuhnya
sesuai dengan syarat akad qard, terutama terkait ketidakjelasan objek utang dan
ketidaksamaan nilai pengembalian dengan pinjaman uang awal. Selain itu,
pelaksanaan praktik ini menyebabkan kerugian finansial bagi masyarakat karena
pemasok memberikan potongan harga di bawah harga pasar tanpa penjelasan yang
jelas sejak awal perjanjian. Dari perspektif maslahah mursalah, praktik ini juga
menunjukkan adanya kerugian moral dan ekonomi karena adanya
ketidakseimbangan manfaat dan mudarat, terutama ketika pemasok memanfaatkan
situasi untuk mendapatkan keuntungan pribadi. Secara prinsip, praktik ini
berpotensi menimbulkan kerusakan dan bertentangan dengan kaidah maslahah
mursalah, yang menuntut pencegahan kerusakan lebih diutamakan daripada
mengambil manfaat.

Settlement of Harvest Results (Seaweed) from the Perspective of Maslahah
Mursalah (Case Study of Waemputtang Village, Poleang Selatan District,
Bombana Regency): First Advisor: Dr. Ashadi L. Diab M.A., M.HUM. Second

This study aims to analyze the practice of debt receivables carried out by
paying off seaweed harvests in Waemputtang Village, Poleang Selatan District,
Bombana Regency, from the perspective of the principle of maslahah mursalah. The
method used is qualitative research with data collection through interviews,
observations, and document analysis. The results of the study indicate that the
practice of debt receivables is not fully in accordance with the terms of the qard
contract, especially regarding the unclear object of the debt and the inequality of
the return value with the initial loan. In addition, the implementation of this
practice causes financial losses to the community because suppliers provide
discounts below market prices without a clear explanation from the beginning of
the agreement. From the perspective of maslahah mursalah, this practice also
shows moral and economic losses due to the imbalance of benefits and harms,
especially when suppliers take advantage of the situation to gain personal gain. In
principle, this practice has the potential to cause damage and is contrary to the
principle of maslahah mursalah, which demands that preventing damage is
prioritized over taking benefits.
