Maslahah Mursalah (Studi kasus Kelurahan Balangnipa Kabupaten Sinjai)

Penelitian ini merupakan penelitian lapangan dengan pendekatan
kualitatif. Adapun tujuan penelitian ini adalah untuk mengetahui praktik jual beli
arisan uang di Kelurahan Balangnipa Kabupaten Sinjai. Selain itu, untuk
mengetahui kesesuaian jual beli arisan uang dengan prinsip Masalahah Mursalah
dalam Islam. Sumber data penelitian ini terdiri dari data primer dan data sekunder.
Selanjutnya Adapun metode pengumpulan data dalam penelitian ini menggunakan
Observasi, dokumentasi dan wawancara. hasil penelitian menunjukkan bahwa
dalam praktik jual beli arisan tidak sah karena terdapat unsur riba, hal ini
dikarenakan adanya potongan dalam hasil arisan tersebut setelah terjadi
kesepakatan dan melakukan akad jual beli. Jika ditinjau dari Maslahah Mursalah
bahwa praktik jual beli arisan uang dalam praktiknya adanya faktor yang
menyebabkan kegiatan tersebut menimbulkan mudharat sehingga tidak dapat
dikatakan Maslahah karena mengandung unsur riba dan bertentangan dengan
prinsip keadilan dalam syariah dan dapat merugikan salah satu pihak.

Gatherings from a Maslahah Mursalah Perspective (Study Kelurahan
Balangnipa Kabupaten Sinjai)

This research is a field research with a qualitative approach. The purpose
of this study is to determine the practice of buying and selling money arisan in
Balangnipa Village, Sinjai Regency. In addition, to determine the suitability of
buying and selling money arisan with the principles of Masalahah Mursalah in
Islam. The data sources for this study consist of primary data and secondary data.
Furthermore, the data collection methods in this study used observation,
documentation and interviews. The results of the study indicate that the practice
of buying and selling money arisan is invalid because it contains elements of
usury, this is due to the deduction of the results of the arisan after an agreement is
made and carrying out the sale and purchase contract. If viewed from Maslahah
Mursalah, the practice of buying and selling money arisan in practice there are
factors that cause the activity to cause harm so that it cannot be said to be
Maslahah because it contains elements of usury and is contrary to the principle of
justice in sharia and can harm one of the parties.
