Abstract

ABSTRAK

La Ode Fardin (2021010203015) Judul Hasil Penelitian “Analisis Penegakan
Hukum Terhaap Tindak Pidana Penganiayaan Akibat Minuman Keras di
Tempat Umum berdasrkan pasal 351 KUHP dengan bimbingan Bapak
Muh.Asrianto , SH., MH sebagai pembimbing1 , dan Bapak Aris Darmawan
Al-Habib, M.H sebagai pembimbing II.
Tujuan penelitian ini adalah untuk mengetahui proses penegakan hukum dan bentuk
pertanggungjawaban pidana terhadap pelaku tindak pidana penganiayaan akibat
pengaruh minuman keras di tempat umum. Penelitian menggunakan pendekatan
yuridis normatif dan empiris, dengan pengumpulan data melalui observasi,
wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa Penegakan
hukum dilakukan melalui proses penyelidikan dan penyidikan oleh aparat
kepolisian, serta penyelesaian melalui pendekatan restorative justice dan mediasi
sebagai upaya mencapai keadilan sosial dan mencegah konflik berkepanjangan.
pertanggungjawaban pidana menegaskan bahwa pelaku yang mampu bertanggung
jawab secara hukum dan tidak dalam keadaan tidak mampu secara mental tetap
harus mempertanggungjawabkan perbuatannya, meskipun dalam keadaan mabuk
sebagaimana diatur dalam Pasal 351 KUHP.

ABSTRACT

La Ode Fardin (2021010203015) Title of The Research: "Analysis of Law
Enforcement Against Assault Crimes Caused by Alcohol Consumption in
Public Places Based on Article 351 of the Criminal Code" Under the
supervision of Mr. Muh. Asrianto, SH., MH as the first supervisor, and Mr.
Aris Darmawan Al-Habib, M.H as the second supervisor.
The purpose of this research is to understand the law enforcement process and the
forms of criminal accountability for perpetrators of assault offenses caused by the
influence of alcoholic beverages in public places. This study uses a normative
juridical and empirical approach, with data collection through observation,
interviews, and documentation. The research results show that law enforcement is
carried out through investigation and inquiry by the police, as well as resolution
through restorative justice approaches and mediation as efforts to achieve social
justice and prevent prolonged conflicts.
Criminal accountability confirms that perpetrators who are legally responsible and
not mentally incapacitated must still be held accountable for their actions, even if
they are intoxicated, as regulated in Article 351 of the Criminal Code.
