Abstract

Riska Umrah. Nim. 2020020102021. Analisis Praktik Sewa-menyewa pada Kolam
Pemancingan Perspektif Hifdz Al–Mal (Studi Kelurahan Raraa, Kecamatan Ladongi,
Kabupaten Kolaka Timur). Dibimbing oleh: Dr. Kartini M.H.I., dan Dr. Andi Yaqub
M.H.I.
Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana
praktik sewa-menyewa pada kolam pemancingan yang ditinjau dengan menggunakan
perspektif hifdz al-mal. Jenis penelitian ini adalah empiris dengan memperoleh data
menggunakan teknik observasi, wawancara dan dokumentasi. Data yang diperoleh
menggunakan teknik reduksi data, penyajian data dan kesimpulan. Subjek pada
penelitian ini yaitu pemilik usaha kolam pemancingan, pemancing dan pengurus MUI
Kolaka Timur. Berdasarkan hasil penelitian, dapat disimpulkan bahwa: pertama,
praktik sewa-menyewa menggunakan sistem pancing harian, di mana pemancing bisa
datang langsung ke lokasi kolam pemancingan mulai dari jam 09.00 – 12.00 WITA
dan 13.00 – 16.00 WITA. Biaya memancing sebesar Rp.50.000,00 untuk waktu
setengah hari dan Rp. 100.000,00 untuk waktu satu hari. Pembayaran dilakukan
sebelum kegiatan pemancing dimulai. Setelah membayar pemancing bebas
memancing di kolam yang telah disediakan dan dapat membawa pulang ikan hasil
pancingannya tanpa perlu dibayar atau ditimbang kembali. Kedua, tinjauan hifdz almal
ditinjau
dari
tingkatan
dharuriyat
yang
terbagi
menjadi
dua
aspek,
yaitu
dari
segi

adanya
(min
nahiyyati
al-wujud)
dan
dari
segi
tidak
adanya
(min
nahiyyati
al-adam.

Aspek

pertama dari segi adanya (min nahiyyati al-wujud) menunjukkan bahwa
praktik tersebut sudah terpenuhi dan sesuai dengan prinsip perlindungan harta dalam
jangka panjang serta keberlanjutan produksi usahaya. Sedangkan aspek kedua yaitu
dari segi tidak adanya (min nahiyyati al-adam) dari tingkatan dharuriyat
menunjukkan bahwa praktik tersebut juga sudah memenuhi prinsip-prinsip
perlindungan harta yaitu perlindungan dari bentuk penipuan dan ketidakadilan.

Kata Kunci: Praktik sewa-menyewa, kolam pemancingan dan hifdz al-mal.

Ponds from the Perspective of Hifdz Al-Mal (Study of Raraa Village, Ladongi
District, East Kolaka Regency). Guided by: Dr. Kartini M.H.I., and Dr. Andi Yaqub

This study aims to determine and analyze how the practice of renting in
fishing ponds is reviewed using the hifdz al-mal perspective. This type of research is
empirical by obtaining data using observation, interview and documentation
techniques. The data obtained using data reduction techniques, data presentation and
conclusions. The subjects in this study were fishing pond business owners, anglers
and administrators of the East Kolaka MUI. Based on the results of the study, it can
be concluded that: first, the practice of renting uses a daily fishing system, where
anglers can come directly to the fishing pond location starting from 09.00 - 12.00
WITA and 13.00 - 16.00 WITA. The fishing fee is IDR 50,000.00 for half a day and
IDR 100,000.00 for one day. Payment is made before the fishing activity begins.
After paying, anglers are free to fish in the pond that has been provided and can take
home the fish they catch without having to pay or weigh it again. Second, the review
of hifdz al-mal is reviewed from the level of dharuriyat which is divided into two
aspects, namely in terms of existence (min nahiyyati al-wujud) and in terms of
absence (min nahiyyati al-adam). The first aspect in terms of existence (min nahiyyati
al-wujud) shows that the practice has been fulfilled and is in accordance with the
principle of long-term property protection and the sustainability of its business
production. While the second aspect, namely in terms of absence (min nahiyyati aladam)

from the level of dharuriyat shows that the practice has also fulfilled the
principles of property protection, namely protection from fraud and injustice.
