Tahun 2018 Terhadap Kinerja Lembaga Kemasyarakatan Desa Perspektif
Fiqih Siyasah Tanfidziyyah (Studi Desa Padabale, Kecamatan Bungku Selatan,
Kabupaten Morowali) Dibimbing oleh Muh. Asrianto Zainal SH,M.Hum dan
Syamsul Darlis S.H., M.H

Permasalahan dalam penelitian ini menunjukkan bahwa tidak adanya
partisipasi LKD untuk membantu kepala desa memasukkan aspirasi masyarakat
dalam pembangunan desa. Penelitian ini bertujuan untuk menganalisis implementasi
Permendagri Nomor 18 Tahun 2018 tentang Lembaga Kemasyarakatan Desa dan
Lembaga Adat Desa serta untuk menganalisis perspektif Fiqih Siyasah Tanfidziyyah
terhadap kinerja Lembaga Kemasyarakatan Desa (LKD). Data diperoleh dari hasil
wawancara dengan kepala desa, aparat desa, pelaksana LKD, dan beberapa
masyarakat, dokumentasi, observasi dan kepustakaan. Metode yang digunakan dalam
penelitian ini adalah metode Hukum Normatif-Empiris. Hasil penelitian ini
menunjukkan bahwa Implementasi Permendagri No 18 Tahun 2018 tentang
Lembaga Kemasyarakatan Desa dan Lembaga Adat desa di Desa padabale masih
belum terlaksana secara maksimal yang disebabkan oleh beberapa faktor diantaranya
: Kualitas sumber daya manusia terbatas yang dimiliki oleh Desa Padabale,
minimnya pengetahuan dan pemahaman tentang Permendagri No. 18 Tahun 2018
tentang Lembaga Kemasyarakatan Desa dan Lembaga Adat Desa oleh para
pelaksana kebijakan, lingkungan sosial ekonomi dan politik memiliki dampak yang
signifikan terhadap implementasi, terutama dalam proses pemilihan anggota,
komunikasi dan koordinasi yang buruk dari para pelaksana kebijakan tersebut yang
dapat menyebabkan konflik, dan karakteristik lembaga yang tidak sesuai terhadap
kebijakan. Kinerja lembaga kemasyarakatan desa padabale belum terlaksana sesuai
dengan syariat dalam fiqih siyasah tanfidziyyah, hal ini disebabkan tidak
terpenuhinya prinsip-prinsip syariah seperti keadilan (al-„adl), kesejahteraan
(maslahah), dan tanggung jawab (amanah).

the Perspective of Fiqh Siyasah Tanfidziyyah (Padabale Village Study, South

The problem in this study shows that there is no LKD participation to help
the village head incorporate community aspirations in village development. This
research aims to analyze the implementation of Permendagri No. 18/2018 on Village
Community Institutions and Village Customary Institutions and to analyze the
perspective of Fiqh Siyasah Tanfidziyyah on the performance of Village Community
Institutions (LKD). Data were obtained from interviews with the village head, village
officials, LKD implementers, and several communities, documentation, observation
and literature. The method used in this research is the Normative-Empirical Legal
method. The results of this study indicate that the Implementation of Permendagri
No. 18/2018 concerning Village Community Institutions and Village Customary
Institutions in Padabale Village is still not maximally implemented due to several
factors including: The limited quality of human resources owned by Padabale
Village, the lack of knowledge and understanding of Permendagri No. 18 of 2018
concerning Village Community Institutions and Village Customary Institutions by
policy implementers, the socio-economic and political environment has a significant
impact on implementation, especially in the process of selecting members, poor
communication and coordination of the policy implementers which can cause
conflict, and the characteristics of institutions that are not in accordance with the
policy. The performance of the Padabale Village Customary Institution has not been
implemented in accordance with sharia in fiqh siyasah tanfidziyyah, this is due to the
non-fulfillment of sharia principles such as justice (al-'adl), welfare (maslahah), and
responsibility (amanah).
