Abstract

Devi Rahmayanti (19020102085). Penetapan Denda Arisan Online Perspektif
Hukum Ekonomi Syariah (Studi Kasus Kelurahan Lamekongga Kabupaten
Kolaka). Dibimbing Oleh: Dr. Kartini M.HI., & Lian Mulyani Muthalib
S.Pd., M.Pd.

Penelitian ini bertujuan untuk mendeskripsikan penetapan denda arisan online
persfektif hukum ekonomi syariah di Kelurahan Lamekongga Kecamatan
Wundulako Kabupaten Kolaka yang terdiri atas : (1) penetapan denda arisan
online di Kelurahan Lamekongga, (2) tinjauan hukum ekonomi syariah terhadap
denda arisan online di Kelurahan Lamekongga. Jenis penelitian ini merupakan
penilitian kualitatif deksriptif, dengan pengumpulan data melalui observasi,
wawancara dan dokumentasi. Teknis analisis data dalam penelitian ini yaitu
menggunakan teknis analisis data oleh Miles dan Hubarman yang terdiri dari
empat rangkayain analisis data yaitu pengumpulan data, reduksi data, pengajian
data dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa (1)
menunjukan bahwa terdapat sistem denda yang diterapkan dengan tujuan untuk
menjaga kedisiplinan peserta arisan dan menjamin kelancaran jalannya arisan.
Meskipun demikian, kebijakan denda ini menimbulkan ketidakpuasan di antara
beberapa peserta arisan yang merasa tidak diberi kesempatan untuk menjelaskan
kondisi keterlambatan mereka. Selain itu, informasi terkait kebijakan denda
dianggap kurang transparan karena baru disampaikan setelah arisan berjalan pada
putaran pertama, sehingga peserta merasa tidak dilibatkan dalam pengambilan
keputusan. (2) Berdasarkan tinjauan Hukum Ekonomi Syariah, dari pandangan
Yusuf Qaradhwi bahwa denda dalam arisan online pada dasarnya diperbolehkan,
sebagaimana dalam pandanganya orang yang berhutang dan mampu membayar,
namun mengulur-ulur waktu pembayaran, maka boleh mengambil denda darinya
dan menganggap denda tersebut adalah sedekah dengan syarat bahwa mengubah
sesuatu yang mubah menjadi wajib asalkan persyaratan tersebut tidak menyalahi
syariat, tidak menghalalkan yang haram atau mengharamkan yang halal.

a Sharia Economic Law Perspective (Case Study of Lamekongga Village,

This study aims to describe the determination of fines for online social gatherings
from the perspective of Islamic economic law in Lamekongga Village,
Wundulako District, Kolaka Regency, which consists of: (1) determination of
fines for online social gatherings in Lamekongga Village, (2) review of Islamic
economic law on fines for online social gatherings in Lamekongga Village. This
type of research is a descriptive qualitative study, with data collection through
observation, interviews and documentation. The data analysis technique in this
study uses data analysis techniques by Miles and Hubarman which consists of
four sets of data analysis, namely data collection, data reduction, data review and
drawing conclusions. The results of this study indicate that (1) there is a fine
system implemented with the aim of maintaining the discipline of social gathering
participants and ensuring the smooth running of the social gathering. However,
this fine policy causes dissatisfaction among some social gathering participants
who feel they are not given the opportunity to explain the conditions of their
delay. In addition, information related to the fine policy is considered less
transparent because it was only conveyed after the arisan had been running in the
first round, so that participants felt they were not involved in decision making. (2)
Based on a review of Sharia Economic Law, the practice of online arisan
Arisannya Kime (AK) in Lamekongga Village contains the potential for injustice
in the application of fines. Although fines (al-Gharamah) in Sharia Economic Law
can be applied as a sanction for parties who break promises, their application in
this arisan is considered not to fulfill the valid requirements according to sharia
principles due to the lack of clarity of the contract and mutual agreement.
