(Perbup) Kabupaten Konawe Selatan No. 18 Tahun 2016 Tentang Kawasan
Tanpa Rokok Perspektif Maqasid Syariah. Dibimbing Oleh Dr. Ahmad Lc.,

Kawasan tanpa rokok adalah ruangan atau area yang dinyatakan dilarang
untuk melakukan kegiatan merokok, mengiklankan produk tembakau, dan
memperjual belikan produk tembakau. Penelitian ini bertujuan untuk mengetahui
bagaimana Implementasi Peraturan Bupati (Perbup) Konawe Selatan No. 18
Tahun 2016 Tentang Kawasan Tanpa Rokok di Kecamatan Moramo dan
bagaimana Perspektif Maqasid Syariah terhadap Implementasi Peraturan Bupati
(Perbup) Konawe Selatan No. 18 Tahun 2016 Tentang Kawasan Tanpa Rokok di
Kecamatan Moramo. Jenis penelitian yang digunakan dalam penelitian ini adalah
kualitatif dengan tipologi penelitian hukum normatif-empiris. Data diperoleh
dengan menggunakan wawancara, observasi, dan dokumentasi. Analisis data
dilakukan dalam tiga tahap yaitu reduksi data, penyajian data, dan penarikan
kesimpulan. Pengecekan keabsahan data dilakukan melalui teknik triangulasi
yaitu triangulasi teknik, waktu, dan sumber. Hasil penelitian yaitu Implementasi
Peraturan Bupati Konawe Selatan No. 18 Tahun 2016 Tentang Kawasan Tanpa
Rokok di Kecamatan Moramo masih belum maksimal karena masih banyak
ditemukan orang-orang yang melakukan kegiatan merokok di kawasan tanpa
rokokupaya yang telah dilakukan oleh pihak yang berwenang dalam penerapan
kawasan tanpa rokok hanya sebatas sosialisasi kepada masyarakat dan siswa-siswi
di sekolah tanpa melakukan evaluasi. Implementasi Peraturan Bupati Konawe
Selatan No. 18 Tahun 2016 Tentang Kawasan Tanpa Rokok Perspektif Maqasid
Syariah dengan pembentukan Perbup yang bertujuan untuk kemaslahatan
masyarakat Kabupaten Konawe Selatan untuk mengurangi polusi asap rokok
berdasarkan Perpektif Maqasid Syariah tujuan pembentukan suatu peraturan
adalah untuk meweujudkan kemaslahatan manusia di dunia dan akhirat.

A non-smoking area is a room or area that is prohibited from smoking, advertising
tobacco products and buying and selling tobacco products. This research aims to
find out how the South Konawe Regent's Regulation (Perbup) No. 18 of 2016
concerning Smoke-Free Areas in Moramo District and what is the Maqasid
Syariah Perspective on the Implementation of South Konawe Regent Regulation
(Perbup) No. 18 of 2016 concerning Non-Smoking Areas in Moramo District. The
type of research used in this research is qualitative with a normative-empirical
legal research typology. Data was obtained using interviews, observation and
documentation. Data analysis was carried out in three stages, namely data
reduction, data presentation, and drawing conclusions. Checking the validity of
the data is carried out through triangulation techniques, namely triangulation of
technique, time and sources. The results of the research are the implementation of
South Konawe Regent Regulation No. 18 of 2016 concerning Non-Smoking
Areas in Moramo District is still not optimal because there are still many people
who smoke in non-smoking areas. The efforts made by the authorities in
implementing non-smoking areas are only limited to outreach to the community
and students in school without conducting an evaluation. Implementation of South
Konawe Regent Regulation No. 18 of 2016 concerning No-Smoking Areas from
the Maqasid Syariah Perspective with the formation of a Regional Regulation
aimed at the benefit of the people of South Konawe Regency to reduce cigarette
smoke pollution based on the Maqasid Syariah Perspective. The aim of forming a
regulation is to realize human benefit in this world and the hereafter.
