Pernikahan Fasid Perspektif Saddu Al-Dżarī’ah (Studi Kasus Di Pengadilan
Agama Lasusua Kabupaten Kolaka Utara Nomor 101/Pdt.P/2021/PA.Lss)”,

Penelitian ini membahas tentang penetapan asal Usul anak hasil
pernikahan fasid perspektif saddu al-dżarī‟ah di Pengadilan Agama Lasusua
Kabupaten Kolaka Utara Nomor 101/Pdt.P/2021/PA.Lss, dengan tujuan penelitian
yaitu untuk mengetahui dan menganalisis penetapan asal Usul anak hasil
pernikahan fasid perspektif saddu al-dżarī‟ah di Pengadilan Agama Lasusua
Kabupaten Kolaka Utara Nomor 101/Pdt.P/2021/PA.Lss. Jenis Penelitian ini
adalah penelitian kualitatif dengan Tehnik pengumpulan data wawancara,
observasi dan dokumentasi. Teknik analisis data yang digunakan dalam penelitian
ini yaitu reduksi data, penyajian data dan conclusion drawing/verification.
Sedangkan pengecekan keabsahan data menggunakan triangulasi sumber data,
triangulasi teknik triangulasi waktu dan member chek. Hasil penelitian
menunjukan bahwa: 1) Realitas penyebab diajukannya permohonan penetapan
asal usul anak hasil pernikahan fasid di Pengadilan Agama Lasusua Kabupaten
Kolaka Utara disebabkan karena anak yang lahir tanggal 05 April 2019 belum
mempunyai akta kelahiran. Dan anak tersebut hanya bisa dinisbatkan kepada
ibunya saja karena antara tanggal lahir anak dan tanggal buku nikah tidak selaras.
Semua itu dikarenakan pada saat menikah secara hukum ibunya masih berstatus
istri orang lain. 2) Akibat hukum dari penetapan asal usul anak hasil pernikahan
fasid di Pengadilan Agama Lasusua Kabupaten Kolaka Utara Nomor
101/Pdt.P/2021/PA.Lss yaitu: a) dengan adanya penetapan asal usul anak tersebut
orang tua dapat mengurus akta kelahiran anak. b) Anak laki laki yang lahir pada
tanggal 05 April 2019 secara hukum dilindungi. c) Dengan adanya akta kelahiran,
kedudukan anak menjadi jelas siapa orang tuanya. 3) Perspektif saddu al-dżarī‟ah
terhadap penetapan asal usul anak hasil pernikahan fasid di Pengadilan Agama
Lasusua Kabupaten Kolaka Utara Nomor 101/Pdt.P/2021/PA.Lss yaitu a)
Penetapan asal usul anak merupakan implementasi saddu al-dżarī‟ah yang
termasuk dalam pemeliharaan keluarga (hifz al-nasl) yang juga dikenal sebagai
pemeliharaan nasab b) Penetapan asal usul anak untuk mengurus akta kelahiran
bagi anak agar tehindar dari bahaya di masa depan dan memperjuangkan hak-hak
anak. Hal ini sesuai dengan qaidah fiqqiyah “Kemudaratan harus dihilangkan” c)
Penetapan asal usul anak merupakan wujud dari memprioritaskan kemaslahatan
anak dan juga rasa tanggung jawab sosial.

This study discusses the determination of the origin of the child's birth
from the fasid marriage perspective of saddu al-dżarī'ah in the Lasusua Religious
Court of North Kolaka District Number 101/Rev.P/2021/PA. Lss, with the
purpose of the study, namely to find out and analyze the determination of the
origin of the child's birth from the fasid marriage perspective of saddu al-dżarī'ah
in the Lasusua Religious Court of North Kolaka District Number
101/Rev.P/2021/PA. Lss. This type of research is qualitative research with
interview, observation and documentation data collection techniques. The data
analysis techniques used in this study are data reduction, data presentation and
conclusion drawing/verification. Meanwhile, checking the validity of the data
using data source triangulation, time triangulation techniques triangulation and
member chek. The results showed that: 1) The reality of the reason for the filing
of the application for determination of the origin of the child from the fasid
marriage at the Lasusua Religious Court of North Kolaka Regency was caused
because the child born on April 05, 2019 did not have a birth certificate. And the
child can only be entrusted to his mother only because between the date of birth of
the child and the date of the marriage book are not aligned. All because at the time
of marriage child‟s mother still has the status of someone else's wife legally. 2)
The legal consequences of determining the origin of the child from the fasid
marriage in the Lasusua Religious Court of North Kolaka District No.
101/Rev.P/2021/PA. Lss are: a) with the determination of the origin of the child,
the parent can take care of the child's birth certificate. b) Boys born on April 05,
2019 are legally protected. c) With the birth certificate, the child's position
becomes clear who the parents are. 3) Saddu al-dżarī'ah's perspective on the
determination of the origin of the child resulting from the fasid marriage in the
Lasusua Religious Court of North Kolaka District No. 101/Rev.P/2021/PA. Lss
i.e. a) The determination of the origin of the child is the implementation of saddu
al-dżarī'ah which is included in the maintenance of the family (hifz al-nasl) also
known as the maintenance of the nasab b) The determination of the origin of the
child to take care of the birth certificate for the child in order to avoid future
danger and fight for the rights of the child. This is in accordance with the qaidah
fiqqiyah "Emergency must be eliminated" c) The determination of the origin of
the child is a manifestation of prioritizing the benefit of the child and also a sense
of social responsibility.
