Nama: Sarnita, Nim: 2020020102036, Judul Skripsi “Praktik Jual Beli Dengan
Sistem Konsep All You Can Eat Perspektif Maslahah (Studi Restoran Jepang
Kin Kaku Kendari)”. Dibimbing oleh: Dr. Kartini, M.H.I., Dan Andi Novita
Mudriani Djaoe, S.H., M.H.
Penelitian ini bertujuan untuk mengidentifikasi dan mengkaji Praktik jual
beli dengan sistem konsep All you can eat Di Restoran Jepang Kin Kaku Di Kota
Kendari berdasarkan Perspektif Maslahah. Metode penelitian yang di gunakan
dalam penelitian ini menggunakan kualitatif. Hasil penelitian ini menunjukkan
bahwa dengan praktik Restoran ini memberlakukan Peraturan yang harus dipenuhi
oleh konsumen yaitu: Pihak Restoran memberikan batasan waktu untuk menikmati
makanan dengan sepuasnya selama 90 menit, Konsumen hanya bisa makan semua
makanan yang sudah dihidangkan di tempat, artinya tidak boleh dibawa pulang,
Makanan yang tersisa di meja saat waktunya sudah habis akan dikenakan denda.
Pandangan maslahah terkait Praktik jual beli dengan konsep all you can eat Di
Restoran Jepang Kin Kaku kota kendari Kaku tidak sesuai dengan prinsip maslahah
karena dalam Praktik jual beli ini membawa ke mudharatan terutama dalam
pembatasan waktu, Makanan tidak boleh di bawa pulang meskipun sudah di beli
dan adanya unsur ketidak jelasan dalam penawaran. Karena salah satu prinsip
penting dalam maslahah adalah menghindari unsur mendekat gharar. konsep ini
memiliki beberapa aspek yang bertentangan dengan prinsip maslahah. Meskipun
pada dasarnya konsep ini memberikan keuntungan bagi konsumen yang dapat
menikmati makanan sepuasnya dengan harga tetap, ada beberapa elemen yang
berpotensi merugikan dari kedua belah pihak, baik pihak konsumen maupun
restoran. Akibatnya, praktik ini tidak selalu selaras dengan tujuan maslahah yang
bertujuan untuk mewujudkan kesejahteraan dan mencegah mudarat.

This study aims to identify and examine the practice of buying and selling
with the All you can eat concept system at Kin Kaku Japanese Restaurant in
Kendari City based on the Maslahah Perspective. The research method used in this
research uses qualitative. The results of this study indicate that the practice of this
restaurant imposes regulations that must be met by consumers, namely: The
restaurant provides a time limit to enjoy unlimited food for 90 minutes, consumers
can only eat all the food that has been served on the spot, meaning that it cannot
be taken home, food left on the table when the time is up will be subject to fines.
The view of maslahah related to the practice of buying and selling with the concept
of all you can eat at Kin Kaku Japanese Restaurant in kendari city Kaku is not in
accordance with the principle of maslahah because in this buying and selling
practice it leads to mudharatan, especially in time restrictions, food cannot be taken
home even though it has been purchased and there is an element of uncertainty in
the offer. Because one of the important principles in maslahah is to avoid the
element of approaching gharar. this concept has several aspects that are contrary
to the principle of maslahah. Although this concept basically provides benefits for
consumers who can enjoy unlimited food at a fixed price, there are some elements
that have the potential to harm both parties, both consumers and restaurants. As a
result, this practice is not always in line with the goal of maslahah which aims to
realize welfare and prevent harm.
