Abstract

ABSTRAK
YUNIARTI RESTIANA, NIM: 18020102012, Problematika Kebijakan Pemerintah Desa Dalam Penetapan Penerima Dana PKH. “(studi implementasi Permensos nomor 1 tahun 2018 tentang Program Keluarga Harapan, di Desa Sumber Jaya, Kecamatan Lalembuu, Kabupaten Konawe Selatan)”, Di bawah bimbingan oleh Bapak Ahmadi S. HI, M.H., sebagai pembimbing I dan Bapak Rusnam S,HI, MH., sebagai Pembimbing II.
Program Keluarga Harapan (PKH) adalah program pemberian bantuan sosial bersyarat kepada keluarga atau orang miskin dan rentan yang terdaftar dalam data terpadu program penanganan fakir miskin, yang diproses oleh Pusat Data dan Informasi Kesejahteraan Sosial dan ditetapkan sebagai keluarga penerima manfaat KPM. Namun kenyataannya di lapang dalam pembagian dana PKH masih terdapat warga yang tergolong mampu namun masih mendapatkan dana bantuan PKH, sebaliknya terdapat warga yang tergolong kurang mampu tetapi tidak mendapatkan dana bantuan PKH.
Tujuan dari penelitian ini untuk mengetahui kebijakan pemerintah desa dalam penetapan penerima dana Program Keluarga Harapan (PKH) studi implementasi permensos nomor 1 tahun 2018, juga untuk mengetahui problematika kebijakan pemerintah desa dalam penetapan penerima dana Program Keluarga Harapan (PKH) studi implementasi permensos nomor 1 tahun 2018.
Penelitian ini menggunakan jenis penelitian Yuridis empiris normatife, yaitu jenis penelitian yang menggabungkan antara penelitian yuridis empiris dan yuridis normatif, yaitu mengkaji sebuah kejadian di masyarakat serta membandingkan dengan peraturan yang terdapat di dalam Undang-undang apakah peraturan yang diterapkan di masyarakat sudah sesuai dengan Undang-undang atau belum, dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus.
Hasil penelitian ini menyimpulkan bahwa kebijakan pemerintah Desa dalam penetapan penerima dana PKH dapat dilihat pada Petunjuk Teknis Graduasi PKH, yaitu: Fasilitator Musyawarah Sosialisasi di Desa/kelurahan, Pengusulan Nama Calon KPM, Mengeluarkan Surat Keterangan Mampu dan Labelisasi. Sedangkan problematika yang terdapat dalam kebijakan pemerintah desa dalam penetapan penerima dana PKH yaitu: Frekuensi Musyawarah Desa Sangat Minim, Tidak Maksimalnya Komunikasi Antar Aparat Pemerintah Desa, Kurangnya Pengawasan Dari Pemerintah Desa Dan Kurangnya Pemahaman Pemerintah Desa.

YUNIARI RESTIANA, NIM: 18020102012, Village Government Policy Problems in Determining PKH Fund Recipients. “(study on thr implementation of thr Minister of Social Affairs Regulation number 1 of 2018 concerning the Family Hope Program, in Sumber Jaya Village, Lalembuu District, South Konawe Regency)”, Under The guidance of Mr. Ahmadi S. HI, M.H., as supervisor I and Mr. Rusnam S, HI, MH., as Advisor II.
Hope Family Program is a program of proving conditional social assistance to poor and vulnerable who are registered in the integrated data of the poor handling program, which is processed by the Counter for Data and information on social welfare and designated as the beneficiary family of KPM. Homever, in reality in the field, in the distribution of PKH funds, there are still people who can afford it but still get the aid funds, on the other hand there are residents who deserve PKH assistance funds but do not get it.
The purpose of this study is to determine the village government’s policy in determining the recipients of the family hope program (PKH) fund recipients for the implementation of social affairs number 1 in 2018, also to find out the problems of village government policies in determining the recipients of the family hope program (PKH) funds for the implementation study of the minister of Social Affairs number 1 year 2018.
This research uses normative empirical juridical research, which is a type of research that combines empirical juridical research that and normative juridical research, namely examining an incident in society and comparing with the regulations contained in the law whether the regulations applied in the community are in accordance with the law. Law or not, using a statutory approach and a case approach.
The results of this study conclude that the village government’s policy in determining the recipients of PKH funds can be seen in the PKH Technical Guidelines, namely: Facilitator of socialization meetings in villages/kelurahan, proposing names of KPM candidates, issuing certificates of ability and labeling. While the problems contained in the village government’s policy in determining the recipients of PKH funds are: The frequency of village deliberation is very minimal, the communication between village government officials is not optimal, the lack of supervision from the village government and the lack of understanding of the village government.
