Adimpleti Contractus dalam Perjanjian Jual Beli Hak Pakai Kios Perspektif
Maqashid Syariah (Studi Kasus Jual Beli Hak Pakai Kios Blok C Nomor 15

Penerapan asas exceptio non adimpleti contractus dalam perjanjian jual beli
hak pakai kios blok c nomor 15 di Pasar Baruga Kendari (selanjutnya di sebut
perjanjian tersebut) merupakan tangkisan yang menyatakan bahwa salah satu pihak
tidak dapat melaksanakan perjanjian seperti yang seharusnya, disebabkan karena
pihak yang lain terlebih dulu tidak melaksanakan perjanjian sebagaimana mestinya.
Tujuan penelitian ini adalah; Untuk mengetahui pelaksanaan isi kontrak perjanjian
tersebut, Untuk mengetahui penerapan asas exceptio non adimpleti contractus
dalam perjanjian tersebut, mengetahui perspektif maqashid syariah terhadap
penerapan asas exceptio non adimpleti contractus dalam perjanjian tersebut. Jenis
Penelitian yang akan digunakan oleh penulis adalah penelitian yuridis empiris.
Sumber data primer dari informan, data sekunder dari dokumen-dokumen terkait.
Hasil penelitian menunjukkan bahwa pelaksanaan kontrak perjanjian tersebut telah
terlaksana sebagian tetapi tidak terlaksana secara menyeluruh dengan alasan bahwa
secara faktual pelaksanaan pemenuhan sebagian hak dari pihak penjual (yang juga
menjadi kewajiban pihak pembeli) yaitu pembayaran tahap pertama sebesar
Rp.40.000.000,- telah dipenuhi oleh pihak pembeli. Penerapan Asas Exceptio Non
Adimpleti Contractus dalam Perjanjian tersebut adalah termuat pada ketentuan
Pasal 10 perjanjian jual beli kios yaitu apabila salah satu pihak melanggar maka
perjanjian ini menjadi batal dengan sendirinya. Asas ini menjadi alasan pembelaan
bagi pihak penjual yang tidak terpenuhi haknya oleh pihak pembeli berupa
pembayaran pelunasan sampai jatuh tempo yang telah disepakati dalam perjanjian
sebelumnya, sehingga pihak penjual tidak juga memenuhi kewajibannya yaitu
penyerahan unit kios kepada pembeli. dalam konteks perjanjian jual beli hak pakai
kios asas exception non adimpleti contractus ini diklasifikasikan menjadi dharuriyat
yang dimana tujuannya yaitu Pemeliharaan Harta.

The application of the principle of exception non adimpleti contractus in the
sale and purchase agreement for the right to use kiosk block C number 15 at Pasar
Baruga Kendari (hereinafter referred to as the agreement) is a denial which states
that one party cannot carry out the agreement as it should, because the other party
previously did not carry out the agreement as it should. The aims of this research
are; To find out the implementation of the contents of the contract agreement, to
find out the application of the exceptio non adimpleti contractus principle in the
agreement, and to know the maqasid sharia perspective on the application of the
exceptio non adimpleti contractus principle in the agreement. The type of research
that will be used by the author is empirical juridical research. Primary data sources
from informants, secondary data from related documents. The results of the
research show that the implementation of the contract agreement has been partially
implemented but not completely implemented for the reason that in fact the
fulfillment of some of the rights of the seller (which is also the obligation of the
buyer), namely the first stage payment of Rp. 40,000,000,- has been fulfilled. by the
buyer. The application of the principle of Exceptio Non Adimpleti Contractus in the
Agreement is contained in the provisions of Article 10 of the kiosk sale and purchase
agreement, namely that if one of the parties violates this agreement will
automatically become null and void. This principle is a defense reason for the seller
whose rights are not fulfilled by the buyer in the form of payment in full until the
maturity agreed in the previous agreement, so that the seller does not fulfill its
obligations, namely handing over the kiosk unit to the buyer. In the context of the
sale and purchase agreement for the right to use the kiosk, the principle of exception
non adimpleti contractus is classified as dharuriyat, the purpose of which is
Property Maintenance.
