Nama : Puspasari, Nim : 18020102036, Judul Skrispsi : “Cacat Kehendak Dalam
Transaksi Jual Beli Handphone Bekas di Pasar Panjang Kota Kendari ditinjau dari
Hukum Ekonomi Syariah”, Pembimbing Pertama : Dr. Kamaruddin S. Ag, SH. MH,
Pembimbing Kedua : Fatihani Baso M.H

Handphone Bekas yang merupakan handphone yang diperbaiki dan
diperbaharui, sehingga handphone tersebut menjadi handphone baru. Tujuan dari
penelitian ini ada untuk mengetahui mengapa cacat kehendak dalam pembelian
handphone Bekas marak terjadi dan ntuk mengetahui bagaimana tinjauan hukum
ekonomi syariah dalam transaksi jual beli handphone Bekas. Adapun Jenis penelitian
ini yaitu kuallitatif dengan menggunakan metode penelitian empiris dengan
pendekatan kasuistik. Teknik pengumpulan menggunakan teknik wawancara,
dokumentasi dan observasi. Berdasarkan hasil penelitian yang penulis lakukan dapat
disimpulkan bahwa yang menjadi penyebab atau faktor cacat kehendak dalam
pembelian handphone Bekas marak terjadi yaitu pertama Faktor harga yang dimana
penjual memberikan harga yang murah pada barang tersebut yang dilakukan ini
terjadi dikarenakan supaya pembeli banyak membeli handphone bekas, kedua Faktor
minat pembeli yang dimana semakin tahun semakin banyak pembeli yang
menginginkan handphone tersebut, sehingga kebanyakan juga dari penjual
mengambil kesempatan dalam melakukan hal yang tidak baik dan ketiga faktor
kelayakan yang dimaksud disini adalah handphone bekas ini termasuk handphone
android ini memiliki kelayakan yang tinggi untuk tetap dipasarkan.. Tinjauan Hukum
Ekonomi Syariah terhadap praktik Transaksi jual beli handphone bekas yang
dilakukan oleh penjual atau pemilik Counter di Pasar Panjang Kota Kendari yaitu :
penjual atau pemilik counter yang melakukan praktik jual beli handphone bekas
belum memenuhi sebagian asas-asas hukum ekonomi syariah yang dimana asas yang
terpenuhi meliputi asas kemudahan, asas sebab yang halal, dan asas kebebasan.
Sedangkan asas yang tidak terpenuhi meliputi asas saling menguntungkan dan asas
i’tikad baik.

the cellphone becomes a new cellphone. The purpose of this study is to find out why
defects of will in buying second hand cellphones are rife and to find out how the
sharia economic law reviews in buying and selling second hand cellphones. The type
of this research is qualitative by using empirical research methods with a casuistic
approach. The collection technique uses interview, documentation and observation
techniques. Based on the results of the research that the author did, it can be
concluded that the cause or factor of the defect of will in buying used cellphones is
rife, namely the first price factor where the seller gives a cheap price on the item,
which is done because so many buyers buy used cellphones, the second factor the
interest of buyers where more and more buyers want these cellphones every year, so
most of the sellers also take the opportunity to do things that are not good and the
three feasibility factors referred to here are used cellphones, including this Android
cellphone, which have a high feasibility to continue to be marketed. Review of Sharia
Economic Law on the practice of buying and selling second hand cellphones carried
out by sellers or counter owners at long market, Kendari City, namely: sellers or
counter owners who practice buying and selling second hand cellphones have not
fulfilled some of the principles of sharia economic law which The principles that are
fulfilled include the principle of convenience, the principle of lawful causes, and the
principle of freedom. While the principles that are not fulfilled include the principle
of mutual benefit and the principle of good faith.
