ABSTRAK
Delfi 17020103028 (2017). Program Studi Hukum Tata Negara/Siyasah Institut
Agama Islam Negeri (IAIN) Kendari. Implementasi Peraturan Daerah
Kabupaten Morowali Nomor 9 Tahun 2016 Tentang Sistem Penyelenggaraan
Ketenagakerjaan Bagi Pekerja Anak Perspektif Maqashid Al-syariah di
Bimbing oleh H. Muhammad Iqbal Lc, MHI.
Penelitian yang berjudul Implementasi Peraturan Daerah Kabupaten Morowali
Nomor 9 Tahun 2016 Tentang Sistem Penyelenggaraan Ketenagakerjaan Bagi
Pekerja Anak bertujuan untuk menjawab beberapa rumusan masalah. Penelitian ini
dilakukan di Kabupaten Morowali Sulawesi Tengah. Peneliti menggunakan jenis
penelitian yuridis empiris yaitu mengkaji ketentuan hukum yang berlaku di
masyarakat dengan pendekatan yuridis sosiologis dan pendekatan kasus yang
dipertajam dengan empiris syar‟i. Data yang diperoleh melalui observasi, wawancara
dengan informan, dan dokumentasi serta didukung data sekunder. Metode analisis
data yang digunakan melalui reduksi data, penyajian data, dan penarikan kesimpulan.
Hasil dari penelitian ini menunjukkan bahwa pelaksanaan Peraturan Daerah
yang mengatur tentang Perlindungan Pekerja Anak di Kabupaten Morowali belum
berjalan secara maksimal dikarenakan adanya hal-hal yang menjadi penghambat
dalam pelaksanaannya. Faktor sosialisasi dan Sumber Daya Manusia/staf yang
menjadi penghambat berjalannya Peraturan Daerah Nomor 9 tahun 2016 di
Kabupaten Morowali, dalam hal ini pengsosialisasian Peraturan Daerah tidak
mencakup seluruh masyarakat di Kabupaten Morowali hanya disebagian masyarakat
saja selain itu, kurangnya jumlah instansi yang berwenang untuk mensosialisasikan
Peraturan Daerah terkait perlindungan anak di masyarakat sehingga jalan Peraturan
Daerah ini dikatakan tidak efektif dalam pelaksanaannya. Sehingga masih banyak
ditemukan anak-anak yang bekerja sebagai buruh bangunan di Kabupaten Morowali
yang berpengaruh kepada kondisi fisik anak karena bekerja sebagai buruh bangunan
akan sangat rentang terhadap abu yang ditimbulkan dari bangunan tersebut, populasi
kendaraan, luka-luka di tangan, yang sangat membahayakan kesehatan dan
perkembangan anak. Dengan demikian hal ini bertentangan dengan tujuan Maqashid
Al-syariah yaitu memelihara keturunan (Hifdz Nasl) dan membuat eksistensi Hifdz
Nasl menjadi terancam sebagai salah satu aspek Dharuriyyah sangat penting untuk
menjaganya.

State Islamic Institute (IAIN) Kendari. The Implementation of the Morowali
District Regulation Number 9 of 2016 concerning the Employment
Implementation System for child workers from the Maqashid Al-syariah
Perspective was guided by H. Muhammad Iqbal Lc, MHI.
The research entitled Implementation of Morowali Regency Regulation
Number 9 of 2016 concerning the Employment Implementation System for child
workers aims to answer several problem formulations. This research was conducted
in Morowali Regency, Central Sulawesi. The researcher uses a type of empirical
juridical research, namely examining the legal provisions that apply in society with a
sociological juridical approach and a case approach that is sharpened by syar‟I
empiricism. Data obtained through observation, interviews with informants, and
documentation and supported by secondary data. The data analysis method used is
through data reduction, data presentation, and drawing conglusions.
The results of this study indicate that the implementation of the Regional
Regulation that regulates the Protection of Child Labor in Morowali Regency has not
run optimally due to things that become obstacles in its implementation. Soci
alization factors and human/staff resources are obstacles to the passage of Regional
Regulation Number 9 of 2016 in Morowali Regency, in this case the dissemination of
the Regional Regulation does not cover the entire community in Morowali Regency,
only part of the community besides that, the lack of the number of authorized
agencies to disseminate Regional Regulation related to child protection in the
community so that this Regional regulation is said to be ineffective in its
implementation. So that there are still many children who work as construction
workers in Morowali Regency which affect the physical condition of children
because working as construction workers will be very susceptible to the ash generated
from the building, the population of vehicles, injuries to hands, which are very
dangerous to health. Child development. Thus this is contrary to the goal of
Maqashid Al-syariah which is to maintain offspring (Hifdz Nasl) and make the
existence of Hifdz Nasl be threatened as one aspect of Dharuriyyah is very important
to guard it.
