Abstract

The formulation of the problem from this research is first, how is the
implementation of the sale and purchase agreement for vegetables and fruits that
have hidden defects in the Baruga Market, Kendari City, second, how is the form
of responsibility for the suppliers of vegetables and fruits that have hidden defects
in the Baruga Market, Kendari City, and third, what is the legal view Islam related
to hidden defects in goods at Pasar Baruga, Kendari City.
The purpose of this study was to determine the implementation of the sale
and purchase agreement of vegetables and fruits that contained hidden defects in
the Baruga market in Kendari City. to find out the form of responsibility for the
supplier of vegetables and fruits that have hidden defects in goods at the Baruga
Market, Kendari City. to find out the views of Islamic law regarding hidden
defects in goods.
As for this type of research, namely by using empirical research methods
which are legal research that uses empirical facts taken from human behavior,
both verbal behavior with the intention that it can be done through direct
observation so that by involving methods from observations, interviews, and
documentation.
Based on the results of the research that the author did, it can be concluded
that the first cause or factor in the implementation of the sale and purchase
agreement for goods in the form of vegetables and fruits that have hidden defects
is that there are still some traders who do not make oral or written agreements in
the process of buying and selling transactions. , the two forms of responsibility for
the supplier of goods at Pasar Baruga, Kendari City are not yet optimal, there are
those who compensate but the way of compensation is by cutting the price if there
is a defect in the goods, the defective goods in question are rotten goods, and there
are those who do not compensate because the supplier there are goods that do not
care to replace the goods if they have been paid in full / in cash, usually the
supplier gives a time limit for the return if there is a defect in the goods one day is
returned and some are not returned, and the three views of Islamic law do not
meet the rules of Islamic law as in the rules - rule of fi qih muamalah in contract
transactions that every transaction must be based on freedom and willingness,
there is no element of coercion or disappointment of either party, if that happens
then the transaction is invalid.
