Abstract

Nama: Yunas Yusran Oheo, Nim: 18020102041, Judul Skrispsi: “Perjanjian
Kerja Pekerja Kontrak Perspektif Undang-Undang Nomor 13 Tahun 2003
(Studi Dinas Pemadam Kebakaran Kota Kendari)”, Pembimbing Pertama:
Dr. Ashadi L. Diab M.A., M.HUM., Pembimbing Kedua: Fatihani Baso M.H
Dinas Pemadam Kebakaran Kota Kendari memiliki jumlah 189 pekerja
kontrak. Tujuan penelitian adalah untuk mengetahui realitas hak-hak pekerja
kontrak di Dinas Pemadam Kebakaran Kota Kendari, hambatan yang timbul dalam
pelaksanaan pemberian hak-hak pekerja kontrak di Dinas Pemadam Kebakaran
Kota Kendari, dan perspektif UU No 13 Tahun 2003 ketenagakerjaan terhadap
hak-hak pekerja pekerja kontrak di Dinas Pemadam Kebakaran Kota Kendari.
Metode penelitian menggunakan kualitatif yaitu menggunakan jenis penelitian
hukum normatif dengan pendekatan lapangan. Teknik pengumpulan data dengan
cara observasi, wawancara dan dokumentasi berupa foto kegiatan visual. Analisis
data dengan cara reduksi data, penyajian data dan menarik kesimpulan. Hasil
penelitian bahwa hak-hak pekerja yang diberikan oleh Dinas Pemadam Kebakaran
Kota Kendari tidak sesuai karena upah/gaji pekerja yang tidak sesuai dengan
resiko pekerjaan yang ada dilapangan dan di sisi lain Dinas Pemadam Kebakaran
Kota Kendari mengikutsertakan para pekerja dalam jaminan kesehatan dan
keselamatan kerja. Dalam kerja sama tersebut Dinas Pemadam Kebakaran hanya
mengikutsertakan pekerjanya sebanyak 173 orang saja sedangkan pekerja kontrak
berjumlah 189 orang. Hal ini berarti adanya ketidak sesuaian pemberian hak-hak
terhadap pekerja Dinas Pemadam Kebakaran Kota Kendari dengan UndangUndang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan Adapun hambatan yang
timbul dalam pemberian hak-hak pekerja kontrak pada Dinasi Pemadam
Kebakaran Kota Kendari adalah bahwa tidak semua pekerja menjadi peserta BPJS
Ketenagakerjaan dikarenakan yang memutuskan Pemerintah Kota serta Pemadam
Kebakaran Kota Kendari harus mengikuti peraturan Walikota Kendari dalam hal
ini Pemerintah Tingkat III atau Kabupaten/Kota, hal ini sesuai dengan Peraturan
Walikota Kendari Nomor 5 Tahun 2016 Tentang Pembentukan Dan Susunan
Perangkat Daerah Kota Kendari dan Dinas Pemadam Kebakaran Kota Kendari
sebagai salah satu SKPD dilingkup Pemerintah Kota Kendari. Oleh karena itu,
segala sesuatu yang menjadi kebutuhan operasional Dinas Pemadam Kebakaran
Kota Kendari harus di koordinasikan kepada Pemerintah Kota. Inilah yang
menjadi faktor penghambat sehingga tidak terpenuhinya hak-hak pekerja, karena
harus menyesuaikan dengan Anggaran Pendapatan Belanja Daerah (APBD) Kota
Kendari.

The aim of the study was to find out how the rights of contract workers in
the Kendari City Fire Service are in accordance with Law Number 13 of 2003
concerning Employment, as well as the obstacles that arise in the implementation
of the granting of contract worker rights in the Kendari City Fire Department. The
research method in research uses qualitative research, namely using normative
legal research types with a field approach. Data collection techniques by way of
observation, interviews and documentation in the form of photos of visual
activities. Data analysis by means of data reduction, data presentation and drawing
conclusions. The results of the study show that the workers' rights granted by the
Kendari City Fire Department are inappropriate because workers' wages/salaries
are not in accordance with the risks of work in the field and on the other hand the
Kendari City Fire Department includes workers in occupational health and safety
insurance. In this cooperation the Fire Department only involved 173 workers,
while contract workers totaled 189 people. This means that there is a discrepancy
in the provision of rights to Kendari City Fire Department workers with Law
Number 13 of 2003 concerning Employment. The obstacles that arise in granting
the rights of contract workers to the Kendari City Fire Service are that not all
workers become BPJS Ketenagakerjaan participants because those who decide the
City Government and the Kendari City Fire Department must follow the Kendari
Mayor's regulations, in this case the Level III or Regency/City Government, this is
in accordance with Kendari Mayor Regulation Number 5 of 2016 concerning the
Formation and Composition of Kendari City Regional Devices and Services The
Kendari City Fire Department as one of the SKPD within the Kendari City
Government. Therefore, everything that becomes the operational needs of the
Kendari City Fire Department must be coordinated with the City Government.
This is the inhibiting factor so that workers' rights are not fulfilled, because they
have to adjust to the Kendari City Regional Revenue and Expenditure Budget
(RREB).
